CREATORS OF RECODIFICATION LECTURED LAWYERS THE OUR LAW FIRM SOUKENÍK – ŠTRPKA ON THE NEW PROCEDURAL CODES

Our lawyers took part in an all-day training course on the new procedural laws: Code of Contentious Civil Procedure, Code of Non-Contentious Civil Procedure and Code of Administrative Procedure in the City Hotel in Bratislava.
Lectures on the current topic were given by the creators of the recodification of civil procedural law, doc. JUDr. Marek Števček, PhD. and JUDr. Jana Baricová.
The most important novelties in the Contentious Civil Procedure are changes in certain legal institutes, used terminology and administrative justice, which become effective on 1 July 2016.
The lecturers mentioned, in particular, preliminary hearing of a case, strict contradictoriness of evidence examination, automatic decisions on costs of proceedings and abandoning the institute of extraordinary appeal as an extraordinary remedy.
They focused on the sections of law, which are commonly applied by legal representatives of parties to proceedings: written submissions to the court and means of procedural attack and defence. They detailed the service of court documents, default and interlocutory judgment, means of appeal and intertemporal legal provisions.
The resulting effect of the recodification will depend on the application of the recodified laws by specific persons and, in particular, by courts. However, the role of legal representatives of parties to proceedings is irreplaceable in this process as they affect the course of the proceedings when pursuing the interests of their clients. Therefore, they need to know the wording of law, but also its purpose.
